provide his written resignation prior to such meeting. If <br />Employee serves the City Council with an unequivocal written <br />notice of his resignation after receipt by Employee of the <br />Notice of Meeting and prior to the commencement of such <br />meeting, City shall remain obligated to pay severance to the <br />extent required by this Section 3. <br />C. In the event Employee voluntarily resigns his position with <br />the City before expiration of the aforesaid term of <br />employment, except as otherwise provided in Subsection 3B, <br />City shall not be obligated to pay the aggregate severance <br />sum designated in Section 3A above. <br />D. If Employee resigns or is terminated, he shall be entitled to <br />accrued vacation, holiday and administrative pay on the same <br />basis extended to Executive Management. <br />E. Employee agrees that the severance pay provided for herein <br />and the other benefits specifically and expressly provided <br />for in this Agreement shall be Employee's sole and exclusive <br />remedy in the event of Employee's resignation and/or <br />termination, and that Employee shall have no other and waives <br />any other rights, claims, demands or actions of any kind <br />against the City, its Council Members, Agency Members, <br />employees, agents, independent contractors, commissioners, <br />and City shall have no other obligation to Employee. <br />3 <br />
