R-105-21 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, ADOPTING THE 2021 UTILITY PHYSICAL SECURITY PLAN <br />WHEREAS, the City of Colton ("City"), a municipal corporation, is authorized under <br />various provisions of the California Constitution and the general laws of California including, <br />specifically, Article XI, section 9(a) of the California Constitution, Public Utilities Code Section <br />10004, and Government Code section 39732(a) to establish, purchase and operate a public utility <br />to furnish its inhabitants with, among other things electricity; and <br />WHEREAS, the City operates the Colton Electric Utility ("CEU") a municipal electric <br />utility through its Public Works and Utility Services department; and <br />WHEREAS, the City of Colton Electric Utility provides cost effective, reliable electric <br />services to residents and businesses in its service territory; and <br />WHEREAS, as a municipal electric utility, CEU is generally subject to the legislative and <br />regulatory requirements applicable to local publically owned electric utilities (POU's); and <br />WHEREAS, in 2014, Governor Brown signed Senate Bill 699 (Stats. 2014, Ch. 550, <br />Sec.2), with an effective date of September 25, 2014, amending California Public Utilities Code <br />Section 364, to require the California Public Utilities Commission (CPUC) to consider adopting <br />rules to address the physical security risks to the distribution facilities of investor owned utilities; <br />and <br />WHEREAS, on January 10, 2019, the CPUC adopted Decision 19-01-018 directing all <br />electric utilities to develop and implement a plan that (1) identifies distribution -level substations <br />that require a greater protection against physical attacks; (2) assesses the risks of a successful <br />physical attack at any identified distribution -level substation and determines whether existing <br />mitigation measures effectively mitigate these risks; and (3) identifies new security measures if <br />any identified risks are not effectively mitigated, and; <br />WHEREAS, each POU is required to have a qualified and independent third -party review <br />of its Utility Physical Security Plan; and <br />WHEREAS, CEU selected the Colton Police Department to perform the third -party <br />review and CEU has incorporated the comments and recommendations of the Police Department <br />in the final version of CEU's Utility Security Plan; and <br />WHEREAS, CEU selected the Colton City Manager to serve as the qualified authority <br />for CEU's Utility Physical Security Plan and the City Manager has reviewed CEU's Utility <br />Physical Security Plan and deemed it adequate; and <br />NOW, THEREFORE, BE IT RESOLVED THAT: <br />The City Council of the City of Colton, California hereby approves in substantive form <br />the Colton Electric Utility Physical Security Plan, dated July 29, 2021, included as an <br />attachment hereto and incorporated herein by reference. <br />2. The Colton City Council hereby selects the City Manager to serve as the qualified <br />authority for the review of the CEU's Physical Security Plan. <br />
