It is necessary to protect and safeguard life, health and property that immediate <br />action be taken to correct conditions in the Encanto Court area to prevent further property <br />damage that is likely to result from weather conditions or other acts of God. <br />3. The City has the power, without the admission of any liability whatsoever to any <br />person or party, to act to safeguard life, health and property in the Encanto Court area. <br />4. The City does not by this Resolution or by any actions that may be taken by the <br />City pursuant to it admit or assume any liability for any property damage or other conditions that <br />may now exist or or that may exist in the future in the Encanto Court area. <br />5. The City Manager, in conjunction with the Director of the Public Works <br />Department, the Manager of the Water Division and the City Purchasing Officer, is hereby <br />authorized and directed to take all steps necessary and to expend all funds necessary to safeguard <br />private and public property and facilities in the Encanto Court area without regard to the bidding <br />requirements for public works contracts set forth in Section 3.08.130 of the Colton Municipal <br />Code if those requirements will require any delay in such action. <br />6. Requirements for performance bonds and other security for any necessary <br />construction work in the Encanto Court area shall remain in effect to the extent that such <br />requirements cause no delay in action on the part of the City. <br />PASSED, APPROVED AND ADOPTED this 13th day of December 1993. <br />ATTEST: <br />Helen A.
