CONSENT AND WAIVER '1'U ANNEXATION '"EhEAS, the City Council of the city of Colton, Calitornia, has previously formed a special maintenance district pursuant to the terms of the "Landscaping and Lighting Act of 19'/2" (the "Act"), being Division 1S, hart z. c.r the :streets and Highways Code of the State of California, said special maintenance district known and designated as MAINTENANCE DISTRICT NUMBER 1 Ther&inatter reterred to as the "Maintenance District"l; and, WHEHEAS; the provisions of Article 11 of Chapter 2 of the Act authorizes the Legislative body to order the annexation of territory to the Maintenance District; and, bYtEHa A`.:, tr,e legislative body may, pursuant to said provisions of the Act, order the annexation of territory to the Maintenance District without rot.lce and hearing or tiling of an .Engineer's "Report" as would otherwise Lim required by the provisions of the Act it all of the owners of property w,thin the territory proposed to be annexed have given written consent to the proposed annexation; and, ,I!t; ZIFA.: the undersigned, the owners of all property within the territory F'11to be annexed to the "Maintenance District" acknowledge that pi: r:;cant. to tre provisions of the Act, the undersigned would be entitled to n. -tic- and hearing and the preparation of an Engineer's ..Report" pertaining tc. the annexation ct the property, acknowledge that they are aware of the r.ropcses annexation to the Maintenance District of the property owned by t.r,e ondersilned, and waives any and all rights which the undersigned may n -w r,avr to notice and hearing or tiling of an Engineer's "Report" nert.aininD to the annexation of the undersign's property to the Maintenance L,st.rict.
