R-08-95 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON IN SUPPORT OF A.B. 74 (BACA) <br />PLEA AGREEMENTS (CRUZ WAIVER) <br />WHEREAS, a "Cruz Waiver" is a legal agreement between a criminal <br />defendant, the prosecutor and the judge pending sentencing that allows the <br />defendant to remain free on his or her own recognizance until sentencing, but <br />that increases a defendant's prison time if he or she fails to appear for <br />sentencing, contacts the victim, breaks any law, or fails to meet with his or her <br />probation officer, as agreed; and, <br />WHEREAS, Assemblyman Joe Baca has introduced A.B. 74, which <br />would prohibit the release of any defendant who has entered a plea of guilty <br />or nolo contendere to a violent felony on a Cruz Waiver prior to sentencing; <br />and, <br />WHEREAS, A.B. 74 would prevent violent criminals from being <br />allowed to roam free on a "Cruz Waiver" pending sentencing. <br />NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council <br />do hereby express their support of A.B. 74 (BACA); and, <br />BE IT FURTHER RESOLVED, that certified copies of this resolution <br />be sent to our state representatives in Sacramento, urging their support for <br />passage of A.B. 74. <br />IN WITNESS WHEREOF, I do hereby set my hand and cause the Seal <br />of the City of Colton to be affixed this 7th day of February, 1995. <br />ATTEST: <br />4Z'6r,C,"(i 7 a-?.�/e�l <br />HELEN A.
