4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-10-21 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, AMENDING PORTIONS OF CHAPTER 3.08 <br />RELATING TO BIDDING, CONTRACTING AND PURCHASES OF <br />SUPPLIES, SERVICES AND EQUIPMENT <br />WHEREAS, the Chapter 3.08 of the Colton Municipal Code relates to bidding, contracting and <br />purchases of supplies, services and equipment; and, <br />WHEREAS, the City Council of the City of Colton wishes to update Chapter 3.08 to establish <br />efficient procedures for the purchase of supplies, general services, professional services and equipment, and <br />establish procedures for bidding and contracting of public works projects consistent with state law; and, <br />WHEREAS, the City Council wishes to establish a process for the City to obtain the best services, <br />and acquire quality supplies and equipment in an overall economic manner at the lowest reasonable cost at <br />the lowest possible cost commensurate with quality needed, to exercise positive financial control over <br />purchases, to maintain the highest ethical standards in awarding public contracts, to clearly define authority <br />for the purchasing function, to encourage competition for public contracts and to aid public officials in the <br />efficient administration of public contracting, and to assure the quality of purchases; and, <br />WHEREAS, the purchasing system established by the updates of this Ordinance are designed to <br />provide appropriate procedures to implement the City's participation in the Uniform Public Construction <br />Cost Accounting Act pursuant to California Public Contract Code, Section 22000 et seq. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA <br />DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Incorporation of Recitals. The City Council hereby finds that all of the foregoing <br />recitals and the staff report presented herewith are true and correct and are hereby incorporated and adopted <br />as findings of the City Council as if fully set forth herein. <br />SECTION 2. Portions of Chapter 3.08 of the Colton Municipal Code are hereby amended to read <br />as follows: <br />Section 3.08.010 of the Colton Municipal Code is amended to read as follows: <br />The purpose of this chapter is to establish efficient procedures for the purchase of supplies, general <br />services, professional services and equipment, and establish procedures for bidding and contracting of public <br />works projects consistent with state law. These procedures shall be interpreted to not be overly time <br />consuming and cumbersome, while allowing the City to obtain the best services, and acquire quality supplies <br />and equipment in an overall economic manner at the lowest reasonable cost at the lowest possible cost <br />commensurate with quality needed, to exercise positive financial control over purchases, to maintain the <br />highest ethical standards in awarding public contracts, to clearly define authority for the purchasing function, <br />to encourage competition for public contracts and to aid public officials in the efficient administration of <br />public contracting, and to assure the quality of purchases. Therefore, a centralized purchasing system is <br />hereby adopted and vested with the authority for the purchase of all City supplies, services and equipment. <br />In addition, this chapter and the purchasing system it establishes is designed to provide appropriate <br />procedures to implement the City's participation in the Uniform Public Construction Cost Accounting Act <br />pursuant to California Public Contract Code, Section 22000 et seq. <br />ii. The definition of "Digital signature" is added to section 3.08.020 of the Colton Municipal <br />23152.06000\24600698.2 - 1 <br />
