When a record is required to be in writing, an electronic record satisfies that requirement, if <br />it is in accordance with the UETA. <br />B. When a signature is required the parties may agree that either: <br />An electronic signature satisfies that requirement, if it is in accordance with the <br />UETA; or <br />2. A digital signature satisfies that requirement, if it is in accordance with Section <br />16.5 of the California Government Code. <br />3. This section is intended to enable the city to use electronic records, electronic <br />signatures, and digital signatures to the fullest extent allowed by law, and does not <br />limit the city's ability to use electronic records, electronic signatures, or digital <br />signatures in any way. All use of electronic records, electronic signatures, and <br />digital signatures by the city shall be in accordance with city administrative policies <br />and procedures, as may be designated and amended from time to time by the city <br />administrator or his or her designee. <br />4. Any use of electronic records, electronic signatures, and digital signatures by the <br />city that is not in accordance with this section and city administrative policies and <br />procedures, or any unauthorized signing of any contract, record, or other document, <br />shall render such contract, record, or other document invalid as not fully and <br />properly executed by the city. <br />Authority to sign or execute contracts, records, or other documents via electronic <br />signatures or digital signatures may be delegated by the City Manager or other City <br />Department Heads to designated city staff members. The act of delegation of <br />electronic signature authority by the City Manager or other City Department Head <br />must be memorialized in writing, including, but not limited to, memorandum, city <br />form, e-mail, or delegation process recorded within electronic signature software. <br />SECTION 3. Based on the entire record before the City Council, and all written and oral evidence <br />presented to the City Council, the City Council hereby finds that this Ordinance is exempt from review under <br />the California Environmental Quality Act ("CEQA"), pursuant to Sections 15060(c)(2) (the activity will not <br />result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) <br />(the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of <br />Regulations, Title 14, Article 3, because it has no potential for resulting in physical change to the <br />environment, directly or indirectly. <br />SECTION 4. If any provision of this Ordinance or the application thereof to any person or <br />circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Ordinance <br />which can be given effect without the invalid provision or application, and to this end the provisions of this <br />ordinance are severable. The City Council hereby declares that it would have adopted this Ordinance <br />irrespective of the invalidity of any particular portion thereof. By enacting this Ordinance, the City ordains <br />that nothing herein shall be deemed to conflict with or duplicate federal or state law, or otherwise or to <br />license any activity that is prohibited thereunder except as mandated by such laws. <br />SECTION 5. The City Clerk shall certify the passage of this Ordinance and shall cause the same to <br />be entered in the book of original ordinances of said City; shall make a minute passage and adoption thereof <br />in the records of the meeting at which time the same is passed and adopted; and shall, within fifteen (15) <br />days after the passage and adoption thereof, cause the same to be published as required by law, in a local <br />23152.06000\24600698.2 - 11 - <br />
