R-16-95 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON APPROVING A CERTAIN DISPOSITION AND <br />DEVELOPMENT AGREEMENT BY AND BETWEEN THE <br />REDEVELOPMENT AGENCY FOR THE CITY OF COLTON AND <br />ALLAN STEWARD <br />WHEREAS, the City of Colton, California (the "City") is a <br />municipal corporation and a charter city duly created and existing <br />pursuant to the Constitution and the laws of the State of <br />California; and <br />WHEREAS, the Redevelopment Agency for the City of Colton (the <br />"Agency"), is a redevelopment agency, a public body, corporate and <br />politic of the State of California, organized and existing pursuant <br />to the Community Redevelopment Law (Part 1 of Division 24) <br />commencing with Section 33000 of the Health and Safety Code of the <br />State of California (the "Act"); and <br />WHEREAS, Allan Steward, as an individual (the "Developer") is <br />acting in the capacity of a developer for the purpose of causing <br />the development of a sitdown restaurant within the City; and <br />WHEREAS, the City and the Agency have previously approved and <br />adopted the Redevelopment Plan for the Agency's Cooley Ranch <br />Redevelopment Project Area (the "Redevelopment Plan"); and <br />WHEREAS, the Agency owns a parcel of land as further described <br />on Exhibit "A" hereto (the "Property"), which it deems should be <br />developed in order to further carry out the purposes and intent of <br />the Redevelopment Plan; and <br />WHEREAS, the Developer has indicated that it desires to lease <br />the Property and construct a sitdown restaurant thereon and <br />thereafter purchase said Property from the Agency; and <br />
