George Fulp has alleged that disclosure of his status as a reporting <br />witness in a potential criminal matter by either a member or members of the City Council or by <br />another City employee as well as other actions reported to have occurred during the investigation <br />of the charges presented is a violation of Penal Code Section 11166(d) and/or 11167(d). <br />9. Through his attorneys, George Fulp has indicated his willingness <br />to waive any claim against the City relating to the alleged violation of Penal Code Section <br />11166(d) and/or I I167(d) in the event that he is provided legal defense in this matter. <br />SECTION 2. In consideration of the waiver of any claim against the City under the <br />provisions of Penal Code Section 11166(d) and/or 11167(d) and in consideration of the execution <br />of a Reservation of Rights Agreement (Exhibit A), the City Council of the City of Colton hereby <br />ratifies, reaffirms and authorizes payment of legal fees in defense of Mr. Fulp in the matter of <br />Turner v. Fulp, in the initial amount of $48,977.10, which represents actual costs incurred <br />through November 5, 1996, and an additional amount not to exceed $39,022.90 in costs to be <br />incurred through completion of this action. <br />PASSED, APPROVED and ADOPTED this 19th day of November 1996. <br />ATTEST: <br />Teresa S.
