R-15-96 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON STATING ITS INTENTION TO GRANT A CABLE <br />TELEVISION FRANCHISE TO TCI CABLEVISION OF <br />CALIFORNIA AND SETTING THE DATE, TIME AND <br />PLACE OF HEARING THEREON <br />WHEREAS, in March of 1980, the City of Colton and Buena Vista Cable TV of Colton <br />entered into a fifteen year franchise agreement (the "Franchise Agreement") for Buena Vista to <br />construct, operate and maintain a cable television system within the incorporated limits of the <br />City of Colton; and <br />WHEREAS, In May of 1993, TCI Cablevision of California ("TCI"), as successor in <br />interest to Buena Vista Cable TV of Colton, assumed all obligations and duties under the <br />Franchise Agreement; and <br />WHEREAS, the Franchise Agreement expired by its terms on March 5, 1995, but has <br />been extended by agreement of the City and the franchises through February of 1996; and <br />WHEREAS, City Staff and TCI have engaged in negotiations for the issuance of a new, <br />non-exclusive franchise agreement under the provisions of Chapter 5.06 of the Colton Municipal <br />Code; and <br />WHEREAS, Section 5.06.210(C) of the Colton Municipal Code requires that the City <br />Council pass a resolution declaring its intention to grant a franchise under the provisions of <br />Chapter 5.06. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON HEREBY <br />RESOLVES AS FOLLOWS: <br />SECTION 1. It is the intention of the City Council for the City of Colton to issue a non- <br />exclusive franchise to TCI Cablevision of California, Inc. on the terms and conditions set forth <br />
