R-32,96 <br />RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF COLTON SUPPORTING <br />JOINING IN THE FILING OF AN AMICUS <br />CURIAE BRIEF IN THE CASE OF CITY OF <br />ALHAMBRA V. IKEMOTO <br />WHEREAS, local property taxes are currently being diverted by the State of California <br />to meet the State's obligation to fund 40% of state-wide public education; and <br />WHEREAS, local property taxes should used for local purposes, not to meet state-wide <br />obligations; and <br />WHEREAS, the State of California has a wide variety of means to generate state-wide <br />taxes to meet its obligation to fund 40% of the cost of public education in California; and <br />WHEREAS, a lawsuit challenging the diversion of local property taxes to state-wide use <br />to meet the State's obligation to fund 40% of the cost of public education in California or for <br />other non -local purposes has been filed by the City of Alhambra; and <br />WHEREAS, that lawsuit, City of Alhambra v. Ikemoto, is currently on appeal and an <br />amicus curiae brief on behalf of a large number of cities has been filed by the City of Redondo <br />Beach; and <br />WHEREAS, the City of Colton has been invited to join in the amicus curiae brief filed <br />by the City of Redondo in the case of City of Alhambra v. Ikemoto; and <br />WHEREAS, the City Council of the City of Colton strongly supports the position taken <br />by the City of Alhambra and wishes to join in the amicus brief prepared by the City of Redondo <br />Beach in the pending litigation. <br />
