Agreement shall be held confidential by the City Manager. Such materials shall not, without the prior <br />written consent of the Council, be used by the City Manager for any purposes other than the <br />performance of his duties. Nor shall such materials be disclosed to any person or entity not connected <br />with the performance of services under this Agreement, except as required by law. <br />E. The City Council is aware of and agrees to comply with Colton <br />Municipal Code Section 2.16.110, which states: <br />"The city Council and its members shall deal with the <br />administrative services of the city only through the city <br />manager, except for the purpose of inquiry, and <br />neither the city Council nor any member thereof shall <br />give orders to any subordinates of the city manager. <br />(Ord. 891 § 10, 1956)" <br />Furthermore, the City Manager shall have the authority and responsibility to <br />approve the use of, and payment of fees for, all legal services utilized by City. <br />3. 541= <br />A. The City Manager's salary shall be One Hundred Thirty-five Thousand <br />Dollars ($135,000.00) per year, payable in installments at the same time as other employees of the <br />City are paid. If the Council grants an across the board salary increase to executive -employees as a <br />group, City Manager shall receive an equivalent percentage salary increase. Otherwise, increases in <br />salary shall be at the sole discretion of the Council. <br />A. Except as otherwise provided herein, City Manager shall receive a <br />flinge benefit package equivalent to that of other executive level City employees as it exists from time <br />to time. <br />B. Automobile/Transportation. The City Manager shall be provided an <br />automobile for his exclusive use. Said vehicle shall be comparable to vehicles assigned to other <br />executive employees of City. Said vehicle shall not be operated by persons other than the City <br />Manager, excepting other employees of the City using the vehicle for City business with the consent <br />of the City Manager. The City understands that since the City Manager will remain on-call at all <br />times, the vehicle may be used for personal as well as official business. Notwithstanding the above, <br />the City Manager agrees that, excepting when required for official business, the vehicle shall not be <br />used for personal use or vacation, outside of the seven Southern California counties consisting of, <br />Riverside, San Bernardino, Orange, Los Angeles, San Diego, Ventura and Santa Barbara. <br />The City shall be responsible for providing liability insurance (bodily <br />injury and property damage) for the City Manager's use of said vehicle.
