Cooley Partners, and Allan Steward Inc., which are collectively <br />referred to herein as the Steward Entities; and <br />WHEREAS, Colton and the Steward Entities have engaged in settlement negotiations <br />to discuss settlement of the Lawsuit; and <br />WHEREAS, on Monday, February 9, 1998, the Board of Directors of the Agency <br />voted to approve a Settlement Agreement concerning the Lawsuit, which Settlement Agreement is <br />attached hereto as Exhibit "A;" and <br />WHEREAS, the City Council desires to approve the Settlement Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF COLTON AS <br />FOLLOWS: <br />SECTION 1. The City Council hereby approves the Settlement Agreement. <br />SECTION 2. The Mayor or his designee is hereby directed to execute the Settlement <br />Agreement. <br />PASSED, APPROVED AND ADOPTED this 17th day of February, 1998. <br />ATTEST: <br />Carolina P.
