R-24-98 <br />A RESOLUTION OF THE CITY OF COLTON AUTHORIZING IT TO <br />OBTAIN STATE SUMMARY CRIMINAL HISTORY INFORMATION <br />FOR EMPLOYMENT, LICENSING OR CERTIFICATION PURPOSES <br />WHEREAS, Penal Code Section 11105(b)(10) authorizes cities to access state <br />criminal history information for employment, licensing, or certification purposes; and <br />WHEREAS, Penal Code Section 11105(b)(10) states that there be a requirement <br />exclusion from employment, licensing, or certification based on specific criminal conduct on <br />part of the subject of record; and <br />WHEREAS, Penal Code Section 11105(b)(10) requires the City Council to specificall <br />authorize access to summary criminal history information for employment, licensing, c <br />certification purposes. <br />NOW, THEREFORE, BE IT RESOLVED, that the City of Colton is her <br />authorized to access summary criminal history information for employment, licensing, <br />certification purposes; and <br />BE IT FURTHER RESOLVED, that the City of Colton shall not consider a person vv <br />has been convicted of a felony or misdemeanor involving moral turpitude eligible <br />employment or licensing; except that such conviction may be disregarded if it is determined t <br />mitigating circumstances exist, or that the conviction is not related to employment or license <br />question. <br />RESOLVED FURTHER that a copy of the resolution shall be filed with <br />Department of Justice. <br />PASSED, APPROVED AND ADOPTED this 17th day of March 1998. <br />ATTEST: <br />CAROLINA P.
