NON -APPROPRIATION OF FUNDS ADDENDt7M ., ' Addendum to Equipment Lease between Mnolta Business Systems, as Lessor, and G i T o Fr Q L -To rj as Lessee, dated, Lease No. Notwithstanding anything in the Lease to the contrary, in the event the Lessee is not granted an appropriation for funds for equipment which will Perform services and functions which in whole or in part are essentially in the 30=0 services and functions for which the equipment was leased (if such appropriation is specifically required to pay the Lease payments herein); and operating funds are not otherwise available to the Lessee to posy the rcntal payments; and there is no other legal procedure by which payment can be made to Lessor or its ass,g=e, and the non -appropriation of fiords did not result from any act or failure to act on the part of the Lessee, Lessee shall have the right to return the equipment to the Lessor (at Lessee's expense, to a destination Lessor directs, in good working condition less normal wear and tear); and terminate this Lease by a Notice to such effect served not less than 30 days prior to the end of Lessee's fiscil year. Upon such premature termination, Lessee may not thereafter acquire fuactionl atIar cquipmcnt for the full original term of the Lease_ In the event, subsequent to such pr eme termination, funds are made available to Lessee for equipment which will perform services and functions which in whole or in pert are the same services and functions for which the Equµpment was originally leased, Lessee agrees, at Lessor's or its assignee's option, to purchase, lease or otherwise acquire such equipment from Lessor or its assignee.
