1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />RESOLUTION NO R-95-98 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DIRECTING THE CITY MANAGER TO EFFECTUATE THE <br />TERMINATION OF THE JACK'S DISPOSAL PERMIT AS OF JUNE 30, 2000 <br />WHEREAS, in 1995, the City began exploring the possibility of privatizing its solid <br />waste/sanitation collection and disposal services, and <br />WHEREAS, in exploring this possibility staff was directed to analyze the impacts <br />privatization would have on the level and quality of service, the City's labor force and the City's <br />finances; and <br />WHEREAS, staff determined and recommended that the City sell its solid <br />waste/sanitation operations and award a single franchise to a single solid waste service company; <br />and <br />WHEREAS, an order to award a single franchise the City had to terminate its <br />existing relationships with various solid waste haulers that were permitted to provide certain limited <br />commercial service within the City; and <br />WHEREAS, the City terminated the rights of companies like Burrtec Industries and <br />BFI to collect solid waste in the City; and <br />WHEREAS, due to the fact that the City had awarded a solid waste permit to Jack's <br />Disposal and the term of the permit could not be terminated prior to June 30, 2000 without cause; <br />and <br />WHEREAS, in 1996, it was the City's clearly stated intention and goal to sell its <br />entire service area; and <br />WI -AREAS, in order to accomplish its goal the City contemplated the termination <br />of Jack's Permit at the earliest possible time in order to contract with a single solid waste <br />franchisee; and <br />WHEREAS, the City's intentions were clearly stated in its request for proposals <br />(RFP) and request for qualifications (RFQ) which both included representations that the City <br />intended to award one single solid waste contract for a service area that included ALL territory <br />within the City's incorporated boundaries; and <br />WHEREAS, the result of awarding a single contract for all of a city's service area <br />represents exclusive rights for the company that is awarded the contract; and <br />WHEREAS, after the completion of an exhaustive and complete procurement <br />process the City awarded a single solid waste contract to Taormina Industries; and <br />
