2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />and (iv) the Development Agreement will not adversely affect the orderly <br />development or the preservation of property values for the property it governs or <br />any other property. <br />The City Council further finds that among the public benefits to accrue to the <br />residents of the City as a result of the Development Agreement are: (a) A Capital <br />Contribution of $10 million toward the design and construction of Barton Road <br />bridge and roadway improvements over the BNSF Railroad right-of-way; (b) Four <br />public access electric vehicle charging stalls; and (c) Two rooftop soar array systems. <br />Section 5. All procedures of the California Environmental Quality Act, Public <br />Resources Code section 21000 et seq. ("CEQA") have be met by Planning <br />Commission approval of Resolution R-27-21, adopting environmental findings <br />pursuant to CEQA, adopting a statement of overriding considerations, certifying the <br />Final Environmental Impact Report (SCH #202029049), and adopting a mitigation <br />monitoring and reporting program for the Barton Road Logistics Center. The City <br />Council affirms the Planning Commission's adoption of Resolution R-27-21 and <br />finding that, per Public Resources Code section 21166 and CEQA Guidelines section <br />15162 that no new or more severe impacts have been identified relating to the <br />Development Agreement that require any additional environmental review. <br />Section 6. The City Clerk shall certify to the adoption of this Ordinance and <br />shall cause the same to be posted as required by law. Pursuant to Government Code <br />section 65868.5, within 10 days following the entering of the Development <br />Agreement, as evidence by the full execution thereof, the City Clerk shall record the <br />Development Agreement with the San Bernardino County Recorder. <br />PASSED, APPROVED, AND ADOPTED this lst daybf February, 2022. <br />ATTEST: <br />CAROLINA R.
