R-09-00 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, ADOPTING THE SUPPLEMENTAL AGREEMENT BETWEEN <br />THE COUNTY OF SAN BERNARDINO AND THE CITY ELIMINATING THE <br />FEBRUARY 11, 2000 CRIMINAL JUSTICE ADMINISTRATIVE FEE <br />INCREASE <br />WHEREAS, the Criminal Justice Administrative Fee (booking fee) was enacted <br />to help mitigate the impact of the State's $431 million reduction of support to counties <br />in 1990, and since being enacted has been the subject of extensive litigation in which <br />Colton has participated along with other cities in the County; and, <br />WHEREAS, Colton and other cities have signed a booking fee settlement <br />agreement with the County and these settlement agreements call for an annual fee <br />increase based upon the Consumer Price Index (CPI) to be implemented on February <br />11th of each year through the year 2000; and, <br />WHEREAS, Colton previously joined with other cities in the County to ask the <br />County Board of Supervisors to repeal booking fees; and, <br />WHEREAS, the County board of Supervisors denied the request to repeal <br />booking fees citing that it would create a financial hardship for the county since the fee <br />generates approximately $4 million annually; and, <br />WHEREAS, any state reimbursement of booking fees to cities based upon July, <br />1997, to July, 1998, actual costs does not address any cost increases by the county, and, <br />WHEREAS, a meeting was held between county staff, city managers, and police <br />chiefs where it was agreed that alternatives would be explored for mitigating booking <br />fees while ensuring the roll back is revenue neutral to the County; and, <br />WHEREAS, waiving the Consumer Price Index (CPI) for one year is a step in <br />what will be an ongoing process to identify mutually agreeable alternatives to reducing <br />the booking fee; and, <br />
