R-18-00 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, CALLING AND GIVING NOTICE OF THE <br />HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE <br />CONSOLIDATED WITH THE PRESIDENTIAL GENERAL <br />ELECTION ON TUESDAY, NOVEMBER 7, 2000, TO FILL THE <br />UNEXPIRED TERM OF THE ELECTED POSITION OF MAYOR <br />WHEREAS, under the provisions of the laws relating to General Law Cities in <br />the State of California, a Special Municipal Election shall be held on the next regularly <br />established election date, Tuesday, November 7, 2000, for the election of a Municipal <br />Officer, to wit, the Mayor; and, <br />WHEREAS, the City of Colton has determined through its electorate that the <br />position of the Mayor shall be an elected position; and, <br />WHEREAS, the duly elected incumbent resigned effective February 15, 2000, <br />leaving vacant the office of Mayor with an unexpired term; and, <br />WHEREAS, Government Code Section 34902(a) provides that "In the case of <br />a vacancy in the office of mayor for any reason, the council shall fill the vacancy by <br />appointment. If the council fails to fill it within 30 days, it shall call an election to fill the <br />vacancy to be held on the next established election date to be held not less than 114 <br />days thereafter." This section further provides that the person appointed or elected to <br />fill said vacancy holds office for the unexpired term of the former incumbent. <br />WHEREAS, in the course of conduct of the election it is necessary for the City <br />of Colton to request services of the County of San Bernardino; and <br />WHEREAS, all necessary expenses in performing this service shall be paid by <br />the City of Colton. <br />1 <br />
