R-55-00 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />AUTHORIZING THE CREATION OF THE COLTON UTILITY AUTHORITY; <br />RATIFYING THE SOLICITATION OF A PROPOSAL FOR THE LEASE OF THE <br />CITY WATER AND WASTEWATER SYSTEMS; AND TAKING CERTAIN OTHER <br />ACTIONS IN CONNECTION THEREWITH <br />WHEREAS, California Public Utilities Code Section 10061 (d) provides that a municipal <br />corporation owing and operating a public utility for furnishing water service may lease a public utility <br />furnishing water service by a resolution adopted by a majority of its legislative body and without lease <br />term or other restrictions stated in any other provision of law; and <br />WHEREAS, the City Council of the City of Colton (the "City") has been advised by the <br />City's staff that the lease of the City owned water system and wastewater to another public entity may <br />have long term benefits of the City; and <br />WHEREAS, the City's staff has recommended that the City consider the lease of the <br />City's municipal water system and wastewater system (collectively, the "Utility") to a joint powers <br />authority comprised of the City and the Redevelopment Agency for the City of Colton (the "Agency") ; <br />F mw <br />WHEREAS, in order to assist the City in the leasing of the Utility Systerp the City and <br />the Agency intend to form a Joint Powers Authority (a public body, corporate and politic) pursuant to <br />a Joint Exercise of Powers Agreement, dated as of July 18, 2000 (the "Joint Powers Agreement"), by <br />and between the Agency and the City, to be designated as the "Colton Utility Authority" (the "Utility <br />Authority"), duly created, established and authorized to transact business and exercise its powers, all <br />under and pursuant to the Joint Powers Law (Articles 1 through 4 of Chapter 5, division 7, Title 1 of <br />the California Government Code) including the power to issue bonds for any of its corporate purposes; <br />and <br />WHEREAS, the City hereby finds and declares that entering into the Joint Powers <br />Agreement will be beneficial to persons residing within the City; and <br />RVPUB\IFJB\571757 <br />I <br />
