R-89-00 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON AUTHORIZING THE FILING OF A GRANT <br />APPLICATION FOR SURFACE TRANSPORTATION <br />PROGRAM FUNDS TO CONSTRUCT THE PEPPER <br />AVENUE EXTENSION PROJECT <br />WHEREAS, the City of Colton is desirous of implementing a project with funds for <br />construction of the Pepper Avenue Extension Project located in the City of Rialto; and <br />WHEREAS, procedures and criteria established by the San Bernardino Associated <br />Governments require a Resolution certifying the approval of applications by the Colton City <br />Council; and <br />WHEREAS, the application contains assurances with which the City of Colton as a <br />joint applicant must comply; and <br />WHEREAS, the City of Colton, if approved, will enter into an agreement with the <br />San Bernardino Associated Governments to carry out the Pepper Avenue Extension project. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Colton. <br />1. That the City of Colton hereby authorizes City of Rialto, City Manager, or his designee, <br />according to the terms of the Memorandum Of Understanding (MOU), approved on <br />October 3, 2000, to apply for funds and, if recommended for funding, conduct all <br />negotiations, execute and submit all documents including, but not limited to, the <br />application, agreements, amendments, payment requests, and all other necessary <br />documents to implement and carry out the purposes of this resolution and completion of <br />the project. <br />2. That the City of Colton, City Manager, or his designee, is hereby authorized and <br />empowered to execute and submit all documents necessary to implement and carry out <br />the purposes of this resolution and completion of the project. <br />3. That the City of Colton agrees to commit matching funds as described in the respective <br />Memorandum of Understanding (MOU) approved on October 3, 2000, by and between <br />the cities of Colton, Rialto, San Bernardino and the County of San Bernardino not to <br />exceed 12 % of the 25 % split. <br />1 <br />
