R-119-01 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, TO VACATE A PORTION OF EUCALYPTUS AVENUE <br />PURSUANT TO SECTION 8330 ET SEQ. OF THE STREETS AND <br />HIGHWAYS CODE. <br />WHEREAS, Streets and Highways Code Section 8331 authorize the City of <br />Colton ("City") to summarily vacate a street or highway if it has been impassable for <br />vehicular travel for five consecutive years and if no public funds have been expended <br />for its maintenance; and <br />WHEREAS, Streets and Highways Code Section 8334(b) permits the City to <br />summarily vacate that portion of a street or highway that lies within property under <br />one ownership provided it does not continue through such property or end touching <br />property under separate ownership; and <br />WHEREAS, a portion of Eucalyptus Avenue, located in the City and more <br />particularly described in the attached Exhibit "A" ("Eucalyptus Avenue"), has never <br />been improved or used for vehicular travel and, as such, no public funds have been <br />expended on its maintenance and it has been impassable for the past five years; and <br />WHEREAS, the property on either side of Eucalyptus Avenue is owned by one <br />property owner, Moss Bros. Ford, and Eucalyptus Avenue dead ends at Interstate 10; <br />and <br />WHEREAS, all public facilities previously within or underlying Eucalyptus <br />Avenue have been relocated to a new location and there are no other public facilities <br />located within or underneath Eucalyptus Avenue; and <br />
