R-14-01 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, CALLING AND GIVING NOTICE OF <br />THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE <br />CONSOLIDATED WITH THE CONSOLIDATED ELECTION ON <br />TUESDAY, NOVEMBER 6, 2001, TO FILL THE UNEXPIRED TERM <br />OF THE ELECTED POSITION OF CITY COUNCIL MEMBER, <br />DISTRICT 5 <br />WHEREAS, under the provisions of the laws relating to General Law Cities in the <br />State of California, a Special Municipal Election shall be held on the next regularly established <br />election date, Tuesday, November 6, 2001, for the election of a Municipal Officer, to wit, City <br />Council Member, District 5; and, <br />WHEREAS, the City of Colton has determined through its electorate that the position <br />of the City Council, District 5, shall be an elected position; and, <br />WHEREAS, the duly elected incumbent vacated the office effective February 6, 2001, <br />leaving vacant the office of City Council, District 5, with an unexpired term; and, <br />WHEREAS, Government Code Section 36512(b) provides that "If a vacancy occurs in <br />an elective office provided for in this chapter, the council shall, within 30 days from the <br />commencement of the vacancy, either fill the vacancy by appointment or call a special election <br />to fill the vacancy. The special election shall be held on the next regularly established election <br />date not less than 114 days from the call of the special election..." This section further <br />provides that the person appointed or elected to fill said vacancy holds office for the unexpired <br />term of the former incumbent. <br />WHEREAS, in the course of conduct of the election it is necessary for the City of <br />Colton to request services of the County of San Bernardino; and <br />l <br />
