Crowe nor the Agency have applied to the Workers' Compensati <br />Appeals board for a ruling pursuant to Government Code Section 21026 on <br />such disability is industrial; and, <br />BE IT FURTHER RESOLVED the primary disabling condition is cardio -vascular. <br />The member is competent to act on his behalf in legally binding retirement matters; and, <br />and, <br />BE IT FURTHER RESOLVED that there is no possibility of third party liability, <br />BE IT FURTHER RESOLVED that the member is separated from hi; <br />employment in the position of Police Chief after expiration of his leave rights un( <br />Section 21025.4 of the Government Code, wherein his last work day on paid status w <br />November 10, 2000 and his retirement date became effective November 11, 2000 a <br />that no dispute as to the expiration of such leave rights is pending; and, <br />PASSED, APPROVED AND ADOPTED this 15th day of January, 2002. <br />CAROLINA P.
