R-78-22 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, COUNTY <br />OF SAN BERNARDINO, CALIFORNIA, APPROVING EXECUTION OF THE JOINT <br />POWERS AGREEMENT CREATING THE PUBLIC ENTITY RISK MANAGEMENT <br />AUTHORITY. <br />WHEREAS, pursuant to the provisions of Sections 990, 990.4, 990.8 and 6500 of the <br />California Government Code, the Public Entity Risk Management Authority ("PERMA") has <br />been created by a Joint Powers Agreement; and <br />WHEREAS, Joint Protection Programs have been developed by PERMA pursuant to <br />the provisions of said Agreement; and <br />WHEREAS, the Agreement provides for additional members to become parties to the <br />Joint Powers Agreement creating PERMA and enter one or more Joint Protection Programs <br />providing self-insurance and loss pooling; and <br />WHEREAS, the self-insurance and loss pooling programs of PERMA, as well as its <br />group insurance coverage programs, offer significant advantages to the City in terms of cost, <br />protection, risk management and loss control advice and assistance, and entering such <br />programs would be in the best interest of the City. <br />WHEREAS, the City desires to confirm its support for the purposes of the PERMA and <br />to join as a member of the same and to appoint its representative to the PERMA Board of <br />Directors; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES HEREBY RESOLVE, ORDER AND DETERMINE THE <br />FOLLOWING: <br />Section 1. That the Mayor of the City of Colton is hereby authorized and directed <br />to execute the Joint Powers Agreement on behalf of the City binding the City to the terms and <br />conditions of said Agreement. The City understands and agrees that, by executing the <br />Agreement, it will be bound by the terms of the Joint Powers Agreement, specifically Article <br />4, "Responsibilities of Members," including the obligation to make deposits and deposit <br />adjustments for joint protection programs it joins. <br />Section 2. That the City hereby joins PERMA for a minimum period of three (3) <br />years beginning on July 1, 2022, and will subsequently be required to make deposits and <br />deposit adjustments as provided in PERMA Joint Powers Agreement. <br />
