R-132-02 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON DECLARING <br />AN EMERGENCY AND DELEGATING AUTHORITY TO THE PUBLIC SERVICES <br />MANAGER TO ORDER ACTIONS REQUIRED FOR INSTALLATION OF A NEW <br />SEWER LATERAL AND AUTHORIZE THE CITY MANAGER TO EXECUTE <br />CONTRACT DOCUMENTS. <br />WHEREAS, Section 22050 of the Public Contract Code governs emergency <br />contracting procedures applicable to the City of Colton; and <br />WHEREAS, Section 22050(a) provides that the City may take actions to <br />remedy an emergency without soliciting competitive bids, if the emergency will not permit a <br />delay resulting from a competitive solicitation for bids and if the action is necessary to <br />respond to the emergency; and <br />WHEREAS, based upon the Staff Report, oral testimony, and otherevidence <br />in the record, the Colton City Council finds that an emergency condition exists at the <br />Carnegie Museum which requires immediate work to install sewer lateral; and <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />1. Based upon the Staff Report, oral testimony, and other evidence in the <br />record, the Colton City council finds that the emergency will not permit a delay resulting from <br />a competitive solicitation for bids, and that the actions authorized herein are necessary to <br />respond to the emergency. <br />2. Randy Rivera, Public Services Manager, is delegated the authority to <br />order the materials and labor to install sewer lateral, and to take any further actions <br />authorized by Section 22050 of the Public Contract Code to respond to the emergency. <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />
