City Public Service Signs. No kiosk sign shall contain more than <br />seven (7) panels. Contractor shall place City public service panels on any kiosk sign that <br />contains five (5) or fewer panels at the time of the City's request. City requests shall be <br />made in writing and shall come only from the City Manager's office. The Contractor shall be <br />required to place up to two (2) City public service panels per kiosk sign at no cost or expense <br />to the City. All public service panels shall meet the kiosk sign specifications attached hereto <br />as Exhibit "B" and incorporated herein by reference. <br />Section 6. Contractor Liabilities, Costs and Expenses. All liabilities, costs and <br />expenses arising out of the siting, installation, and construction of kiosksigns and panels, as <br />well as out of the administration of the provisions of this Program, shall be borne by the <br />contractor. The City shall have no obligation whatsoever relating to or arising out of such <br />liabilities, costs or expenses, except as expressly provided for herein. <br />Section 7. Kiosk Sign and Panel Approval: Criteria. The installation of each <br />kiosk sign and the placement of each panel on each kiosk sign shall be reviewed and <br />approved by the Community Development Director without review by the Planning <br />Commission or the Design Review Committee. A proposal shall be submitted by the <br />contractor to the Community Development Director for each kiosk sign and/or panel, which <br />plan shall include the location of the proposed kiosk sign, the name of eachsubdivision tract, <br />apartment complex and/or recreational vehicle dealer to be given a panel on the kiosk sign, <br />and a statement that the kiosk signs and panels shall comply with all requirements of this <br />Resolution. The Community Development Director shallapprove a proposal which complies <br />with the following: (1) all kiosk signs shall be located only in those authorized locations <br />indicated in Exhibit "A" attached hereto; (2) all kiosk signs and panels shall be constructed <br />and painted in compliance with the kiosk sign specifications attached hereto as Exhibit "B" <br />and incorporated herein by reference; (3) any kiosk sign proposal on private property shall be <br />accompanied by the written consent of the landowner; (4) any kiosk sign proposal on public <br />property shall be accompanied with a City Encroachment Permit application; and (5) kiosk <br />signs shall not obstruct the view of the traveling public, as determined in the City Engineer's <br />sole and absolute discretion. <br />Section 8. Kiosk Prohibitions. All kiosk signs and panels located thereon shall <br />comply with the following: (1) nothing other than a directional arrow and the name of the <br />subdivision tract, apartment complex or recreational vehicle dealer shall appear on each <br />panel; (2) any panel approved for a particular subdivision tract, apartment complex or <br />recreational vehicle dealer shall not be changed to advertise another such entity without <br />approval of the Community Development Director pursuant to Section 7; (3) there shall be no <br />additional tag signs, streamers, devices, display boards or appurtenances added to the kiosk <br />signs or panels as originally approved; (4) no directional panels other than those authorized <br />pursuant to this Resolution or otherwise by the City Municipal Code shall be used; (5) no <br />panels shall advertise subdivision tracts, apartment complexes or recreational vehicle dealers <br />located outside of the City limits; (6) panels advertising subdivision tracts shall be allowed to <br />remain until the tract is sold out, or twelve (12) months, whichever comesfirst, unless an <br />extension is approved by the Community Development Director; (7) panels advertising <br />apartment complexes and recreational vehicle dealers shall be allowed to remain unfil the <br />entity ceases to do business in its location; (8) no subdivision tract, apartment complex or <br />recreational vehicle dealer shall have more than one panel per kiosk; provided, however, that <br />any recreational vehicle dealer that is the only such dealer located north of Washington <br />RIVPUBIDRD/617732 <br />
