R-38-02 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />APPROVING TEMPORARY TOW TRUCK FRANCHISE AGREEMENTS <br />WHEREAS, the City Council (the "City Council") of the City of Colton (the "City") <br />adopted Ordinance No. 0-18-98 setting forth criteria to evaluate and select tow <br />franchises as Chapter 10.40, et seg., of the Colton Municipal Code; and <br />WHEREAS, under Section 10.40.030 (b), the City shall award up to four (4) tow <br />truck franchises, and <br />WHEREAS, under Section 10.40.030 (d), in granting a tow truck franchise, the <br />City Council may prescribe such other terms and conditions, not in conflict with this <br />chapter, as determined by the City Council to be in the best interest of the City and the <br />public; and <br />WHEREAS, the City Council wishes to award temporary towing franchises to fill <br />two vacant towing franchise positions in order to maintain efficient Police Department <br />operations and prevent temporary loss of franchise revenue to the City; <br />NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY <br />THE CITY COUCNIL OF THE CITY OF COLTON AS FOLLOWS: <br />Section 1. Approval of Temprary Franchise Agreements The City Council <br />hereby approved the temporary franchise agreements with South State Towing and <br />Exclusive Towing attached hereto as Exhibits "A" and "B", respectively. <br />PASSED, APPROVED, AND ADOPTED, this 26`h day of March, 2002. <br />ATTEST: DEIRDRE H.
