R-50-02 <br />A RESOLUTION OF THE COLTON UTILITY AUTHORITY OF THE CITY OF <br />COLTON DECLARING THAT AN EMERGENCY CONDITION EXISTS WITH <br />THE CITY'S WATER SUPPLY AND DELEGATING AUTHORITY TO THE CITY <br />MANAGER TO ORDER ACTIONS TO ENSURE THE RELIABLE DELIVERY <br />OF A PURE, WHOLESOME AND POTABLE WATER SUPPLY <br />WHEREAS, Section 22050 of the State Public Contract Code governs emergency <br />contracting procedures applicable to the City of Colton; and, <br />WHEREAS, Section 22050 of the Public Contract Code allows the Colton Utility <br />Authority to pass a resolution by a four-fifths vote of its membership declaring that, (a) <br />emergency conditions exist that do not permit a delay resulting from a competitive <br />solicitation for bids; and, (b) the repairs are necessary to respond to the emergency; and, <br />WHEREAS, the Colton Utility Authority finds, based upon the Staff Report and other <br />information in the record, that emergency conditions exist at Well No. 5 and Well No. 22, <br />which meet the requirements of Section 22050, and that the City Manager took appropriate <br />action to respond to such emergency. <br />NOW, THEREFORE, THE UTILITY AUTHORITY OF THE CITY OF COLTON DOES <br />HEREBY RESOLVE AS FOLLOWS: <br />1. The Colton Utility Authority hereby ratifies the City Manager's actions to order <br />materials and labor, in an amount Not -to -Exceed $56,564.07, to rent submersible pump <br />equipment for Well #5 and to repair the motor at Well #22, pursuant to Section 22050 of the <br />Public Contract Code, to respond to the stated emergency. <br />PASSED, APPROVED and ADOPTED this 7th day of May 2002. <br />4&'ln AA1 <br />Aacm <br />A ST: DEIRDRE H.
