R-99-22 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON APPROVING. <br />THE 2021 ANNUAL POWER SOURCE DISCLOSURE REPORT, THE 2021 <br />POWER CONTENT LABEL, AND ATTESTATION OF THE VERACITY OF THE <br />ANNUAL REPORTS` <br />WHEREAS, Senate Bill 1305 was adopted in 1997, establishing a Power Source <br />Disclosure Program that requires .retail. sellers of electricity to annual submit a power source <br />disclosure report to the California Energy Commission, and, <br />WHEREAS, the Colton Electric Utility is a retail seller of electricity as defined by the <br />Power Source Disclosure Program, and; <br />WHEREAS, the Power Source Disclosure Regulation was updated effective October <br />31, 2015, requiring an annual audit by an outside certified public accountant of the information <br />in the annual Power Source Disclosure Report, and; <br />WHEREAS, Assembly Bill 1110, as passed in 2016, and the regulation for Power <br />Source Disclosure was amended, and. the changes effective. in 2020 for reporting year 2019 <br />and forward, to include disclosure of greenhouse. gas (GHG} emissions intensity associated <br />with each °electricity portfolio., and. to include changes to the reporting form to disclose the <br />unbundled renewable energy credits (RECs) as a percentage of retail sales, and; <br />WHEREAS,. a publically owned utility (POU) is exempt from the annual audit <br />requirement if the governing body of the POU.approves :at a public meeting the. submission <br />to the Energy Commission of an attestation of the.veracityof the annual report, and; <br />WHEREAS, Colton Electric Utility staff prepared and submitted the 2021 Annual Power <br />Source Disclosure Report to the Energy Commission in accordance with the Regulation, and; <br />WHEREAS, at the. Regular Meeting of the Colton Utilities Commission Meeting on <br />August 10, 2020, the Utilities Commission recommended that the City Council approves the <br />submission of the annual report and provides an attestation of the veracity of the annual report. <br />WHEREAS, CEO staff has been informed by California Energy Commission staff that <br />the attestation. of the veracity of the annual report must also reference the information provided <br />in the annual Power Content Label,. and; <br />WHEREAS, the 2021 Power Content Label template was released by California <br />Energy Commission for use by CED,..and other load -serving entities on July 29, 2022. CED <br />staff.has completed the 2021 Power Content Label and the information on the document is the <br />same as the information reported on Page 6 of CED's 2021 Power Source Disclosure annual <br />report. <br />
