The City Council declares its intention to conduct proceedings pursuant to said Article 3.5 for the annexation to the District of the territorydescribed in Exhibit "A" attached hereto. The City Council determines that the public convenience and necessity require that such territory be annexed to the District. Section 4. Description of Territory Proposed To Be Annexed- Annexation Map. The territory which is included in the District is described on the map of the District recorded on June 30, 2021, in Book 8.9 of Assessment and Maps,. at Page 77, and as File No.. 2021-0296813 in the official records of the County of San Bernardino. The territory proposed to be annexed to the District is described in Exhibit 'A' attached hereto and by this reference made a part hereof. Such territory is also. shown and described on the map thereof entitled "Annexation Map No. 1, City of Colton Community Facilities District No. 2021-1, County of .San Bernardino, State of California., which is on file with the City Clerk (the "Annexation Map") - Section 5. Types.. of Services;_ _ Incidental Expenses. A general description of the services which are to be funded with the. revenues from special taxes which are to be levied on parcels of taxable property within the District is as follows: (a) Police protection services; and (b) Fire protection services. The District shall also finance costs associated with the determination of the amount of and the levy and collection of special taxes which are. levied to provide such services and costs otherwise incurred in order to carry out the authorized purposes of the District. .Section 6. Special Taxes. Except where funds are otherwise available., special taxes sufficient to, pay the costs of the Services provided for in Section 5 above and the annual administrative expenses of the City and the District in determining, apportioning, levying and collecting such special taxes, shall. be annually levied within the District. Pursuant to Section 53340 of the California Government. Code., the special taxes shall be collected in the same manner as ordinaryad valorem property taxes are collected and shall. be subject to the same penalties and the same procedure, sale, and lien priority in case of delinquency as is provided for ad valorem taxes. However, under .no circumstances. shall the special tax levied against any parcel subject to the levy of the special tax pursuant to the rates and method of apportionment be increased as a consequence of delinquency or default by the owner of any other parcel or parcels within the District by more than ten percent (1.0%).
