R-94-22 <br />A. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA; VACATING CERTAIN PORTIONS OF SOUTH TERRACE <br />AVENUE AND DE BERRY STREET PURSUANT TO STREETS AND HIGHWAYS <br />CODE. SECTIONS 8320 ET SEQ., AND DETERMINING THAT SUCH VACATION <br />IS CONSISTENT WITH THE CITY'S GENERAL PLAN <br />WHEREAS, the. City of Colton ("City") is presently engaged in. issuing various entitlements <br />and approvals relating to. redevelopment of.a warehouse logistics center in the Light Industrial <br />(M-1 } District in the City (the 'Project').; and <br />WHEREAS, the applicant has requested that the City vacate certain portions of South <br />Terrace Avenue and De Berry Street (as described and depicted in Ex hibits.A and B to this <br />Resolution,. and made a part hereof by this reference) (the uVacated Area"); and <br />WHEREAS, this vacation. of. a City -owned street is made pursuant to. the requirements of <br />California Streets and. Highways Code sections 8320 ef.seq., General Vacation Procedure;:and <br />WHEREAS,.the Vacated Area is no longer needed for public right of way or alley purposes, <br />and is unnecessary for present or prospective public use; and <br />WHEREAS, there are existing public utilities and easements for public utilities in the <br />Vacated Area and appurtenant rights thereto that will be reserved. for the City and other public <br />agencies. in accordance with California Streets and. Highways Code Section 8340;.and <br />WHEREAS, there.are no other in -place public utility facilities that are in use and would be <br />affected by the vacation; and <br />WHEREAS, Section 831.3(b) of the Streets and Highways Code and Section 65402 of the <br />Government Code require that any proposed vacation.be reviewed for conformity with the City's <br />General. Plan; and <br />WHEREAS, the Planning Commission; on December 14, 2021, and City Council, on <br />October 04, 2022, have determined that this vacation is. consistent with and in conformity with <br />the General Plan of the City of Colton; and <br />WHEREAS,. on July 1.9, 2022, the City Council adopted Resolution No. R-87-22 <br />("Resolution of Intent"} to vacate the Vacated Area, as more particularly described in said <br />Resolution; and <br />WHEREAS, the Resolution of Intent gave notice that on October 4, 20122. at 5:00 p.m., in <br />the Colton City Council Chambers, the City Council would hear any. and all persons interested <br />in or objecting to the. proposed vacation of the Vacated.
