4 <br />U <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />26 <br />27 <br />28 <br />SECTION 5. Termination of Easements. This reserved easement shown on the Final <br />Map shall automatically terminate and be of no further effect, without further action by grantor <br />or any grantee, as to Colton Water, Colton Wastewater, and Colton Electric, and their <br />successors, heirs, and assigns, when (i) their facilities located within this easement area are <br />relocated to the easement areas set forth for their respective uses on the Final Map and (ii) <br />those facilities have commenced operations at the new location. With respect to Southern <br />California Gas Company, AT&T, and Lumen Technologies, and their successors, heirs, and <br />assigns, respectively, this reserved easement shall automatically terminate and be of no further <br />effect, without further action by grantor or grantee, as to each of them individually when (i) their <br />respective facilities located within this easement area are relocated by the grantor upon terms <br />and conditions acceptable to the affected utility and (ii) their respective facilities have <br />commenced operations at the new location. This reserved easement shall run with the land <br />and bind the successors to the property which is the subject of the temporary easement. <br />Pursuant to California Streets & Highways Code, Section 8335, the City Engineer is hereby <br />authorized to terminate the existing reserved easement shown on the Final Map on behalf of <br />the City once the City accepts the relocated easement shown on the Final Map. <br />SECTION 6. Recordation of Resolution. The City Clerk is directed to cause a certified <br />copy of this Resolution of Vacation to be recorded in the office of the San Bernardino County <br />Recorder. <br />SECTION 7. Authorization. The City Engineer (or other City official deemed appropriate <br />or otherwise authorized by City) is hereby authorized to and shall sign deliver all documentation <br />necessary to effectuate the vacation of the iidentified portions of South Terrace Avenue and De <br />Berry Street, including executing and delivering any quitclaim deeds evidencing the City's <br />transfer of an interest in the subject vacated area to the fee owners.. <br />SECTION S.
