R-16-03 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, PURSUANT TO GOVERNMENT <br />CODE SECTION 21025, MAKING DETERMINATION OF <br />DISABILITY STATUS FOR LOCAL SAFETY EMPLOYEE <br />KENNETH SCOTT SCHILLER <br />WHEREAS, THE City of Colton (hereinafter referred to as Agency) is a contracting <br />agency of the Public Employees' Retirement System; and <br />WHEREAS, The Public Employees' Retirement Law requires that a contracting <br />agency determine whether an employee of such agency is in employment in which he is <br />classified as a local safety member; is disabled for purposes of Public Employees' <br />Retirement Law; and, whether such disability is "industrial" within the meaning of such law; <br />and <br />WHEREAS, the City Council confirms that a worker's CompensationClaim was filed <br />by Kenneth Scott Schiller alleging disability from his position as Police Detective and that a <br />settlement agreement has been entered into by the interested parties; and, <br />WHEREAS, the City Council has reviewed the medical and other evidence relevant <br />to such alleged disability. <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />The City of Colton hereby finds and determines that Kenneth S. Schiller was <br />rendered incapacitated within the meaning of the Public Employees' Retirement Law for <br />performance of his duties in the position of Police Detective, that the disability was the <br />result of illness or disease, specifically, metastatic esophageal cancer, under the provisions <br />of Government Code Section 21156; and, <br />BE IT FURTHER RESOLVED that the City Council finds and determines that <br />Kenneth S. Schiller was incapacitated within the meaning of the Public Employees' <br />
