RESOLUTION NO R-130-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, ADOPTING RATES FOR SOLID WASTE COLLECTION SERVICES, APPROVING FIRST AMENDMENT TO AMENDED AND RESTATED AGREEMENT BETWEEN THE CITY OF COLTON AND CR&R, INC. FOR THE COLLECTION OF MUNICIPAL SOLID WASTE AND FINDING THE ACTION EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, as a result of regulations implementing Senate Bill (SB) 1383 (Short-Lived Climate Pollutants (SLCP): Organic Waste Methane Emissions Reductions) that took effect January 1, 2022, organic waste can no longer be disposed of in landfills and organic waste collection services must be extended to all residents and businesses; and WHEREAS, SB 1383 directed the California Department of Resources Recycling and Recovery ("CalRecycle") to adopt certain regulations to implement SB 1383 (the "SB 1383 Regulations"); and WHEREAS, to comply with the SB 1383 Regulations, the City of Colton (the "City") negotiated with its waste hauler,CR&R Incorporated("CR&R")to provide the necessary services; and WHEREAS, the City and CR&R desire to amend the Amended and Restated Agreement Between the City of Colton and CR&R, Inc. for the Collection of Municipal Solid Waste (the "Agreement")to implement additional solid waste diversion programs; and WHEREAS, the City and CR&R have finalized an amendment to the Agreement that reflects the new and modified services, attached hereto as Exhibit B (the "Amendment"); and WHEREAS,the rate structure for the monthly solid waste service fees has three customer classes: (i) single family residential; (ii)multi-family residential; and (iii) commercial; and WHEREAS, the rate structure for trash, recycling, and organic waste collection is based on the container size,type of service, and frequency of collection; and WHEREAS, the City has determined that it is necessary to impose new, increased, or modified rates for its solid waste service charges (collectively herein,the"Charges"); and WHEREAS, the revenues derived from the Charges will not exceed the funds required to provide the solid waste services and shall be used exclusively for the provision of solid waste collection services; and WHEREAS,the amount of the Charges will not exceed the proportional cost of the service attributable to each parcel upon which they are proposed for imposition; and 23152.06040\40409419.1
