RESOLUTION NO R-130-22 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> COLTON, CALIFORNIA, ADOPTING RATES FOR SOLID <br /> WASTE COLLECTION SERVICES, APPROVING FIRST <br /> AMENDMENT TO AMENDED AND RESTATED AGREEMENT <br /> BETWEEN THE CITY OF COLTON AND CR&R, INC. FOR <br /> THE COLLECTION OF MUNICIPAL SOLID WASTE AND <br /> FINDING THE ACTION EXEMPT FROM THE CALIFORNIA <br /> ENVIRONMENTAL QUALITY ACT <br /> WHEREAS, as a result of regulations implementing Senate Bill (SB) 1383 (Short-Lived <br /> Climate Pollutants (SLCP): Organic Waste Methane Emissions Reductions) that took effect <br /> January 1, 2022, organic waste can no longer be disposed of in landfills and organic waste <br /> collection services must be extended to all residents and businesses; and <br /> WHEREAS, SB 1383 directed the California Department of Resources Recycling and <br /> Recovery ("CalRecycle") to adopt certain regulations to implement SB 1383 (the "SB 1383 <br /> Regulations"); and <br /> WHEREAS, to comply with the SB 1383 Regulations, the City of Colton (the "City") <br /> negotiated with its waste hauler,CR&R Incorporated("CR&R")to provide the necessary services; <br /> and <br /> WHEREAS, the City and CR&R desire to amend the Amended and Restated Agreement <br /> Between the City of Colton and CR&R, Inc. for the Collection of Municipal Solid Waste (the <br /> "Agreement")to implement additional solid waste diversion programs; and <br /> WHEREAS, the City and CR&R have finalized an amendment to the Agreement that <br /> reflects the new and modified services, attached hereto as Exhibit B (the "Amendment"); and <br /> WHEREAS,the rate structure for the monthly solid waste service fees has three customer <br /> classes: (i) single family residential; (ii)multi-family residential; and (iii) commercial; and <br /> WHEREAS, the rate structure for trash, recycling, and organic waste collection is based <br /> on the container size,type of service, and frequency of collection; and <br /> WHEREAS, the City has determined that it is necessary to impose new, increased, or <br /> modified rates for its solid waste service charges (collectively herein,the"Charges"); and <br /> WHEREAS, the revenues derived from the Charges will not exceed the funds required to <br /> provide the solid waste services and shall be used exclusively for the provision of solid waste <br /> collection services; and <br /> WHEREAS,the amount of the Charges will not exceed the proportional cost of the service <br /> attributable to each parcel upon which they are proposed for imposition; and <br /> 23152.06040\40409419.1 <br />
