1 ORDINANCE NO. 0-11-22 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> 3 <br /> COLTON CALIFORNIA AMENDING COLTON MUNICIPAL CODE <br /> SECTION 3.04.030 REGARDING THE AUTHORITY OF THE CITY <br /> 4 MANAGER RELATED TO CLAIMS AGAINST THE CITY <br /> 5 WHEREAS, Title 3, Chapter 3.04, Section 3.04.030 of the Colton Municipal Code <br /> 6 states that the City Council delegates to the City Manager the authority to allow, <br /> compromise, or settle claims for an amount of up to Twenty-Five Thousand Dollars <br /> ($25,000); and <br /> 8 WHEREAS,Title 3, Chapter 3.04, Section 3.04.030 was last updated in 2004; and <br /> WHEREAS, it is the intent of the City Council to promote greater efficiency in the <br /> 9 settlement and compromise of claims against the City; and <br /> 10 WHEREAS, the City Council desires to increase the City Manager's settlement <br /> authority and grant additional flexibility to the City Manager in order to allow the City <br /> 11 Manager to provide prompt and cost effective resolution of claims arising minor occurrences, <br /> 12 incidents, and/or accidents resulting in potential damage exposure to the City. <br /> NOW, THEREFORE, the City Council of the City of Colton, California, does <br /> 13 ordain as follows: <br /> 14 SECTION 1. Incorporation of Recitals. The City Council hereby finds that all of the <br /> foregoing recitals and the staff report presented herewith are true and correct and are hereby <br /> 15 incorporated and adopted as findings of the City Council as if fully set forth herein. <br /> 16 SECTION 2. Amending the Colton Municipal Code Section 3.04.030. Colton <br /> Municipal Code Section 3.04.030 Authority of City Manager is hereby amended in its <br /> 17 entirety to read: <br /> 18 "3.04.030—Authority of City Manager <br /> A. The City Council delegates authority to the City Manager and his or her designee <br /> 19 to review all claims for sufficiency and to reject any and all claims. The City Council <br /> 20 delegates to the City Manager authority to allow, compromise, or settle claims for an amount <br /> up to Fifty Thousand Dollars ($50,000). The City Council shall have the sole authority to <br /> 21 allow, compromise, or settle claims for an amount in excess of Fifty Thousand Dollars <br /> 22 (>$50,000)." <br /> B. The City Manager may further delegate the settlement authority outlined in <br /> 23 Section 3.04.030(A) of the Colton Municipal Code. Prior to such delegation of settlement <br /> 24 authority, the City Manager shall develop or cause to be developed, policies and procedures <br /> as are necessary to encourage consistent application and provide guidance to designees <br /> 25 regarding evaluation and settlement of potential claims." <br /> 26 SECTION 3. Except as amended above, all other sections of the Colton Municipal <br /> Code shall remain unchanged. <br /> 27 SECTION 4. Compliance with California Environmental Quality Act. Based on the <br /> 8 entire record before the City Council, and all written and oral evidence presented to the City <br />
