R — 86-03 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />ELECTING TO CEASE TO BE SUBJECT TO THE PUBLIC <br />EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT ON BEHALF OF <br />THE CITY CLERK AND CITY TREASURER UNIT <br />WHEREAS, Government Code Section 22853 provides that a contracting agency <br />which has elected to be subject to the Public Employees' Medical and Hospital Care Act <br />(hereinafter "Act") may cease to be so subject by proper application by the contracting <br />agency; and <br />WHEREAS, the City of Colton (hereinafter referred to as "Special District") is a <br />contracting agency under the Act for participation by members of the City Clerk and City <br />Treasurer Unit. <br />NOW, THEREFORE BE IT FURTHER RESOLVED by the Mayor and City Council of <br />the City of Colton as follows: <br />SECTION 1. That the City Clerk and City Treasurer Unit members of the Special <br />District elect, and the Special District does hereby elect, to cease to be subject to the <br />provisions of the Act. <br />SECTION 2. That coverage of the Act cease on December 31, 2003. <br />SECTION 3. That Title 2, Section 599.515 (e), of the California Administrative Code <br />prohibits the Contracting Agency from filing with the Board of Administration of the Public <br />Employees' Retirement System a new resolution electing to be subject to the Act within two - <br />years of termination date. (Presently, CaIPERS has filed an emergency regulation with the <br />Office of Administrative Law amending section 599.515(e) to require contracting agencies to <br />xxxxx <br />0' 1 1, <br />1 <br />
