I. OVERVIEW <br /> A. INTRODUCTION <br /> The City of Colton ("City") annually levies and collects special assessments in <br /> order to provide financing for maintenance, servicing, and operation of the <br /> improvements within the existing Landscape and Lighting Maintenance District <br /> No. I ("District"). The District was formed and is levied annually pursuant to the <br /> Landscape and Lighting Act of 1972, Part 2 of Division 15 of the California <br /> Streets and Highways Code ("1972 Act") and is in compliance with the <br /> substantive and procedural requirements of the California State Constitution, <br /> Article XIIID ("Article XIIID"). <br /> The Engineer's Annual Levy Report ("Report") describes the District, any <br /> changes to the District, and the proposed assessments for Fiscal Year <br /> 2023/2024. The assessments are based on the historical and estimated costs <br /> necessary to maintain the improvements that provide a direct and special benefit <br /> to properties within the District. The District includes five distinct Benefit Zones <br /> ("Zones"). The improvements within the District and the corresponding costs are <br /> budgeted and assessed separately for each Zone, including all expenditures, <br /> deficits, surpluses, revenues, and reserves. <br /> For the purposes of this Report, the word "parcel" refers to an individual property <br /> assigned its own Assessor's Parcel Number by the San Bernardino County <br /> Assessor's Office. The San Bernardino County Auditor/Controller uses <br /> Assessor's Parcel Numbers and specific Fund Numbers to identify properties <br /> assessed for special district benefit assessments on the tax roll. <br /> On July 17, 2007 the City conducted a property owner protest ballot relating to <br /> the addition of Zone 3 improvements and the addition of an inflator to the Zone 3 <br /> assessment formula, as well as the annexation of Tract 16912 to Zone 3. At the <br /> public hearing, the tabulation of the owner protest ballots did not result in a <br /> majority protest regarding any of the ballot issues. <br /> At a noticed annual Public Hearing, the City Council will accept all public <br /> comments and written protests regarding the District and the annual levy of <br /> assessments. Upon conclusion of the Public Hearing, the City Council will <br /> consider all public comments and review the Report. The City Council may order <br /> amendments to the Report or confirm the Report as submitted. Following final <br /> approval of the Report and confirmation of the assessments the Council will, by <br /> Resolution, order the improvements to be made and confirm the levy and <br /> collection of assessments pursuant to the 1972 Act.
