1 RESOLUTION NO. R-53-23 <br /> 2 A RESOLUTION OF THE CITY COUNCIL OF COLTON, CALIFORNIA <br /> 3 APPROVING THE ANNUAL ENGINEER'S REPORT FOR THE COLTON <br /> LANDSCAPE AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. <br /> 4 II FOR FISCAL YEAR 2023/2024 <br /> 5 WHEREAS, the City of Colton ("City") is a municipal corporation duly organized and <br /> existing pursuant to the Constitution and laws of the State of California; and, <br /> 6 <br /> WHEREAS,the City Council of the City of Colton, California, has, by previous Resolutions, <br /> ordered the preparation of the Engineer's Annual Levy Report ("Engineer's Report") for the <br /> 8 "Colton Landscape and Lighting Maintenance Assessment District No. II ("District") pursuant to <br /> the provisions of the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets <br /> 9 and Highways Code of California, beginning with Section 22500 ("Act"); and, <br /> 10 WHEREAS, there has been presented to this City Council the Engineer's Report as <br /> required by Chapter 3, Section 22623 of said Act as previously directed by Resolution; and, <br /> 11 <br /> WHEREAS, this City Council has carefully examined and reviewed the Engineer's Report <br /> 12 as presented, and is satisfied with the Engineer's Report, each and all of the budget items and <br /> 13 documents as set forth therein, and is satisfied that the assessments, have been spread in <br /> accordance with the special benefits received from the improvements, operation, maintenance <br /> 14 and services to be performed within each Benefit Zone of the District, as set forth in said <br /> Engineer's Report. <br /> 15 <br /> NOW,THEREFORE BE IT RESOLVED, DETERMINED,AND ORDERED BY THE CITY <br /> 16 COUNCIL FOR THE DISTRICT, AS FOLLOWS: <br /> 17 Section 1 The above recitals are true and correct. <br /> 18 <br /> Section 2 The Engineer's Report as presented, consists of the following: <br /> 19 • A Description of the District and Improvements; <br /> 20 • The Annual Budget (Costs and Expenses of Services, Operations and Maintenance); <br /> 21 • A Description of the Method of Apportionment resulting in an Assessment Rate per Levy <br /> Unit within said District for Fiscal Year 2023/2024; <br /> 22 District Assessment Diagrams showing the exterior boundaries of the Assessment <br /> 23 <br /> • District and/or the Benefit Zones therein; <br /> 24 • A Listing of the proposed assessment for each Assessor's Parcel Number within the <br /> District for Fiscal Year 2023/2024. <br /> 25 <br /> Section 3 The Engineer's Report is hereby approved on a preliminary basis pending a public <br /> 26 hearing, and ordered to be filed in the Office of the City Clerk as a permanent record and to <br /> 27 remain open to public inspection. <br /> 28 Section 4 The Engineer's Report as presented is hereby approved (subject to modifications <br /> and amendments directed by the City Council at the Public Hearing) and is ordered to be filed <br /> in the Office of the City Clerk as a permanent record and to remain open for public inspection. <br />
