1 RESOLUTION NO. R-53-23 2 A RESOLUTION OF THE CITY COUNCIL OF COLTON, CALIFORNIA 3 APPROVING THE ANNUAL ENGINEER'S REPORT FOR THE COLTON LANDSCAPE AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. 4 II FOR FISCAL YEAR 2023/2024 5 WHEREAS, the City of Colton ("City") is a municipal corporation duly organized and existing pursuant to the Constitution and laws of the State of California; and, 6 WHEREAS,the City Council of the City of Colton, California, has, by previous Resolutions, ordered the preparation of the Engineer's Annual Levy Report ("Engineer's Report") for the 8 "Colton Landscape and Lighting Maintenance Assessment District No. II ("District") pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets 9 and Highways Code of California, beginning with Section 22500 ("Act"); and, 10 WHEREAS, there has been presented to this City Council the Engineer's Report as required by Chapter 3, Section 22623 of said Act as previously directed by Resolution; and, 11 WHEREAS, this City Council has carefully examined and reviewed the Engineer's Report 12 as presented, and is satisfied with the Engineer's Report, each and all of the budget items and 13 documents as set forth therein, and is satisfied that the assessments, have been spread in accordance with the special benefits received from the improvements, operation, maintenance 14 and services to be performed within each Benefit Zone of the District, as set forth in said Engineer's Report. 15 NOW,THEREFORE BE IT RESOLVED, DETERMINED,AND ORDERED BY THE CITY 16 COUNCIL FOR THE DISTRICT, AS FOLLOWS: 17 Section 1 The above recitals are true and correct. 18 Section 2 The Engineer's Report as presented, consists of the following: 19 • A Description of the District and Improvements; 20 • The Annual Budget (Costs and Expenses of Services, Operations and Maintenance); 21 • A Description of the Method of Apportionment resulting in an Assessment Rate per Levy Unit within said District for Fiscal Year 2023/2024; 22 District Assessment Diagrams showing the exterior boundaries of the Assessment 23 • District and/or the Benefit Zones therein; 24 • A Listing of the proposed assessment for each Assessor's Parcel Number within the District for Fiscal Year 2023/2024. 25 Section 3 The Engineer's Report is hereby approved on a preliminary basis pending a public 26 hearing, and ordered to be filed in the Office of the City Clerk as a permanent record and to 27 remain open to public inspection. 28 Section 4 The Engineer's Report as presented is hereby approved (subject to modifications and amendments directed by the City Council at the Public Hearing) and is ordered to be filed in the Office of the City Clerk as a permanent record and to remain open for public inspection.
