R-73-23 <br /> 2 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br /> 3 GRANTS AN APPEAL AND MODIFIES THE PLANNING COMMISSION'S <br /> DECISION (FILE INDEX DAP 001-668) APPROVING A CONDITIONAL <br /> 4 USE PERMIT TO ALLOW A BUILDING HEIGHT OF 130 FEET INSTEAD <br /> 5 OF 50 FEET MAXIMUM FOR PARCEL 1 BUILDING 1, (LOCATED AT <br /> 1500 AGUA MANSA ROAD) (FILE INDEX NO: DAP-001-815) <br /> 6 <br /> 7 WHEREAS, on August 20,2013 (Resolution No. R-60-13),the City of Colton,as the lead <br /> agency under the California Environmental Quality Act ("CEQA"), certified a General Plan <br /> 8 Environmental Impact Report("General Plan EIR")and approved the General Plan on August 20, <br /> 2013; and <br /> 9 WHEREAS, as part of its approval of the General Plan, City adopted Findings of Fact, <br /> 10 Statement of Overriding Considerations and a Mitigation Monitoring and Reporting Program for <br /> the General Plan; and <br /> 11 <br /> WHEREAS, pursuant to CEQA Guidelines section 15183, projects which are consistent <br /> 12 with the development density established by existing zoning, community plan, or general plan <br /> 13 policies for which an EIR was certified shall not require additional environmental review, except <br /> as might be necessary to examine whether there are project-specific significant effects which are <br /> 14 peculiar to the project or its site; and <br /> 15 WHEREAS, Lineage Logistics sought City approvals to allow for the construction and <br /> operation of a new warehouse/office building at 1500 Agua Mansa Road ("Project"), including <br /> 16 the approval of a Conditional Use Permit providing for a building height of 130 feet; and <br /> 17 WHEREAS, the City has conducted an analysis of the Project, consistent with CEQA <br /> 18 Guidelines section 15183 ("Section 15183 Analysis"); and <br /> 19 WHEREAS,on February 28,April 11,April 25,and May 9,2023 the Planning Commission <br /> of the City of Colton ("Planning Commission") held duly noticed public hearings at which all <br /> 20 persons wishing to testify in connection with the application were heard and the Project application <br /> 21 was fully examined; and <br /> 22 WHEREAS,on May 9,2023,the Planning Commission approved the Project,including the <br /> Conditional Use Permit for a building height of 95 feet, and found that the Project, is in <br /> 23 conformance with the analysis and conclusions of the General Plan EIR, that there are no new <br /> significant off-site or cumulative impacts that were not analyzed in the General Plan EIR,that there <br /> 24 are no adverse impacts that are more severe than those previously identified in the General Plan <br /> 25 EIR; and <br /> 26 WHEREAS, an appeal application (File Index No. DAP 001-815) was filed with the City <br /> of Colton by Pamela Steele of MIG Inc., (hereinafter "Applicant") appealing the provision of <br /> 27 Conditional Use Permit in order to allow a warehouse building of 130 feet in height instead of 50 <br /> feet maximum located in the M-2(Heavy Industrial)Zones within the Agua Mansa Historic District <br /> 28 <br />
