• <br /> 2 RESOLUTION NO. R-65-23 <br /> 3 A RESOLUTION OF THE CITY COUNCIL OF COLTON, CALIFORNIA <br /> ACCEPTING INTEREST IN REAL PROPERTY CONVEYED BY THAT CERTAIN <br /> 4 QUITCLAIM DEED DATED MAY 26, 2023 CONTAINED WITHIN, FROM <br /> ELSINORE VALLEY MUNICIPAL WATER DISTRICT (EVMWD), A SPECIAL <br /> 5 DISTRICT <br /> 6 WHEREAS, the City of Colton ("City") issued various entitlements and approvals relating <br /> 7 to redevelopment of a warehouse logistics center in the Light Industrial (M-1) District in the City <br /> (the "Project"); and <br /> 8 WHEREAS, the applicant has requested that the City accept interest in real property <br /> 9 conveyed by that certain quitclaim deed dated May 26, 2023 contained within (as described <br /> and depicted in Exhibits C-3 and C-4 to this Resolution), from Elsinore Valley Municipal Water <br /> 10 District (EVMWD), a Special District; and <br /> 11 WHEREAS, the interest in real property is no longer needed by EVMWD for any purpose; <br /> and <br /> 12 <br /> WHEREAS, acceptance of interest in real property is in conformity with the City's General <br /> 13 Plan; and <br /> 14 WHEREAS, the Mayor is hereby authorized to execute and deliver quitclaim deeds <br /> 15 evidencing city's acceptance of any interest in the subject real property from the fee owners. <br /> 16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Colton: <br /> 17 <br /> SECTION 1. General Plan Consistency. The City Council hereby finds that acceptance <br /> 18 of Interest in Real. Property via a Quitclaim, as more specifically described and depicted in the <br /> attached Exhibits C-3 and C-4, is consistent and in conformity with the Mobility Element of the <br /> 19 General Plan of the City of Colton. <br /> 20 SECTION 2. Findings of Quitclaim Deed Area. The interest in real property <br /> 21 area to be accepted by the City of Colton via quitclaim deed as described and depicted in <br /> Exhibits C-3 and C-4 of this Resolution is not needed by Elsinore Valley Municipal Water District <br /> 22 (EVMWD) for any purposes. To support this finding, staff obtained an executed wet-signed <br /> original copy of a Quitclaim Deed by EVMWD General Manager, Greg Thomas, dated May 26, <br /> 23 2023. <br /> 24 SECTION 3. Order of Acceptance. Based on the above stated facts, conclusions, and <br /> findings, the City Council hereby accepts interest in real property via a Quitclaim Deed for the <br /> 25 area described and depicted in Exhibits C-3 and C-4 to this Resolution. <br /> 26 <br /> 27 SECTION 6. Recordation of Resolution. The City Clerk is directed to cause a certified <br /> copy of this Resolution of Quitclaim Deed to be recorded in the office of the San Bernardino <br /> 28 County Recorder. <br />
