1 Development Agreement: (i) the City will promote orderly growth and quality <br /> development on the Property in accordance with the goals and policies set forth in <br /> 2 the General Plan; (ii) significant benefits will be created for City residents and the <br /> public generally from increased employment, property tax revenue, and <br /> 3 contributions from Developer toward public capital improvements; and <br /> 4 WHEREAS, the City and Developer have reached mutual agreement and <br /> desire to voluntarily enter into the Development Agreement to facilitate <br /> 5 development of the Project subject to conditions and requirements set for therein; <br /> and <br /> 6 <br /> WHEREAS, on June 20, 2023, the City Council held a duly advertised public <br /> 7 hearing on the Development Agreement; and <br /> 8 WHEREAS, at the public hearing, the City Council considered the Staff <br /> Report, the Development Agreement, and public testimony. <br /> 9 <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF <br /> 10 COLTON DOES ORDAIN AS FOLLOWS: <br /> 11 Section 1. Pursuant to California Government Code Section 65865, the City <br /> 12 <br /> Council hereby approves the Development Agreement, attached hereto as Exhibit <br /> "A", entitled "A Development Agreement between City of Colton and IDI Agua <br /> 13 Mansa, LLC, a Delaware limited liability company" (aka "Agua Mansa Logistics <br /> Center, Building 2 Development Agreement") (the "Development Agreement"). <br /> 14 Section 2. Based on the entire record before the City Council and all written <br /> 15 and oral evidence presented, the City Council finds this Development Agreement not <br /> be detrimental to the health, safety and welfare of the community because the <br /> 16 Development Agreement will permit land uses that best reflect community needs, <br /> including the need for local employment opportunities and increased property tax <br /> 17 revenue to fund City services, and will allow for the most efficient and logical <br /> development of the real property governed by the Development Agreement in the <br /> 18 City. <br /> 19 Section 3. Pursuant to California Government Code Section 65867.5(b), and <br /> based on the entire record before the City Council, including all written and oral <br /> 20 evidence presented, the City Council hereby finds that the Development Agreement <br /> is consistent with the General Plan because the Development Agreement will result <br /> 21 in the development of the Property that is consistent with the uses and intensity <br /> allowed under the General Plan. <br /> 22 Section 4. Based on the entire record before the City Council and all <br /> 23 written and oral evidence presented, the City Council finds that: (i) the economic <br /> interests of Colton citizens and the public health, safety and welfare will be best <br /> 24 served by entering into the Development Agreement; (ii) this Development <br /> Agreement is compatible with the uses authorized in, and the regulations prescribed <br /> 25 for, the area in which the Property is located; (iii) the Development Agreement is in <br /> conformity with the public convenience, general welfare and good land use practice; <br /> 26 and (iv) the Development Agreement will not adversely affect the orderly <br /> development or the preservation of property values for the property it governs or <br /> 27 any other property. <br /> 28 The City Council further finds that among the public benefits to accrue to the <br />
