1 RESOLUTION NO. R-84-23 <br /> 2 A RESOLUTION OF THE CITY COUNCIL OF COLTON, CALIFORNIA <br /> 3 APPROVING 2022 ANNUAL POWER SOURCE DISCLOSURE REPORT, 2022 <br /> POWER CONTENT LABEL, AND ATTESTATION OF THE VERACITY OF THE <br /> 4 ANNUAL REPORTS <br /> 5 WHEREAS, Senate Bill 1305 was adopted in 1997, establishing a Power Source <br /> Disclosure (PSD) Program that requires retail sellers of electricity to annual submit a PSD <br /> 6 report to the California Energy Commission (CEC), and, <br /> 7 WHEREAS, the Colton Electric Utility (CEU) is a retail seller of electricity as defined <br /> 8 by the PSD Program, and, <br /> 9 WHEREAS,the PSD Regulation was updated effective on October 31, 2016, requiring an <br /> annual audit by an outside certified public accountant of the information in the annual PSD <br /> 10 Report, and, <br /> 11 WHEREAS, Assembly Bill 1110 (AB 1110), as passed in 2016, amended the regulation <br /> for PSD, and the changes effective in 2020 for reporting year 2019 and forward, to include <br /> 12 disclosure of greenhouse gas (GHG) emissions intensity associated with each electricity <br /> 13 portfolio, and to include changes to the reporting form to disclose the unbundled renewable <br /> energy credits (RECs) as a percentage of retail sales, and, <br /> 14 <br /> WHEREAS, a publicly owned utility (POU) is exempt from the annual audit requirement <br /> 15 If the governing body of the POU approves at a public meeting the submission to CEC of an <br /> attestation of the veracity of the annual report, and, <br /> 16 <br /> WHEREAS, CEU staff prepared and submitted the 2022 Annual PSD Report to CEC <br /> 17 in accordance with the Regulation, and, <br /> 18 WHEREAS, On September 11, 2023, Colton Utilities Commission (UC) recommended <br /> 19 that the City Council (CC) approves the submission of the annual report and provides an <br /> attestation of the veracity of the annual report. <br /> 20 <br /> WHEREAS, CEU staff has been informed by CEC staff that the attestation of the <br /> 21 veracity of the annual report must also reference the information provided in the annual Power <br /> Content Label (PCL), and, <br /> 22 <br /> 23 WHEREAS, the 2022 PCL template was released by CEC on August 16, 2023. CEU staff <br /> has completed the 2022 PCL and the information on the document is the same as the <br /> 24 information reported on Page 7 of CEU's 2022 PSD annual report. <br /> 25 <br /> NOW,THEREFORE BE IT RESOLVED, DETERMINED,AND ORDERED BY THE CITY <br /> 26 COUNCIL FOR THE DISTRICT, AS FOLLOWS: <br /> 27 Section 1 The above recitals are true and correct. <br /> 28 Section 2 Approve the submission of 2022 Annual Power Source Disclosure Report, 2022 <br />
