Staff Report to the Mayor and City Council <br />Adult Use Regulations Code Amendment <br />October 17, 2023 <br />Page 3 <br /> <br /> <br />review under the California Environmental Quality Act (“CEQA”), pursuant to Sections <br />15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical <br />change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section <br />15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Article 3, because it <br />has no potential for resulting in physical change to the environment, directly or indirectly. <br /> <br />FISCAL IMPACTS <br /> <br />The zoning text amendment will establish amortization periods for nonconforming adult uses <br />Citywide to specify how long a non-conforming adult business may exist at a particular site <br />before it must comply with all current regulations. No fiscal impacts are anticipated with this <br />amendment. <br /> <br />ALTERNATIVES <br /> <br />1. Provide alternative direction to staff. <br /> <br />ATTACHMENT <br />1. Attachment 1.
