1 ORDINANCE NO. 0-11-23 <br /> 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF COLTON, CALIFORNIA ADDING SECTION 18.49.170 <br /> 3 TO THE COLTON MUNICIPAL CODE TO ESTABLISH <br /> AMORTIZATION PERIODS FOR NONCONFORMING <br /> 4 ADULT USES <br /> 5 <br /> WHEREAS, the City of Colton ("City") is a California municipal corporation organized <br /> 6 <br /> pursuant to the California Constitution; and <br /> 7 <br /> 8 WHEREAS, pursuant to Article XI, Section 7 of the California Constitution, the City <br /> may adopt and enforce ordinances and regulations not in conflict with general laws to protect and <br /> 9 <br /> promote the public health, safety, and welfare of its citizens; and <br /> 10 <br /> WHEREAS, current provisions of the City's Municipal Code contained in Chapter 18.49 <br /> 11 <br /> deem adult uses that are not in compliance with the zoning, design and performance standards as <br /> 12 <br /> public nuisances and contrary to the health, safety and welfare of the residents of the City; and <br /> 13 <br /> WHEREAS, in accordance with the City's above-referenced authority, the City Council <br /> 14 <br /> wishes to amend its Municipal Code provisions regarding the requirements for adult business <br /> 15 <br /> compliance and amortization periods; and <br /> 16 <br /> NOW, THEREFORE, the City Council of the City of Colton, California, does ordain as <br /> 17 <br /> follows: <br /> 18 <br /> 19 SECTION 1. Incorporation of Recitals. The City Council hereby finds that all of the <br /> 20 foregoing recitals and the staff report presented herewith are true and correct and are hereby <br /> incorporated and adopted as findings of the City Council as if fully set forth herein. <br /> 21 <br /> 22 SECTION 2. Adding Section 18.49.170 to the Colton Municipal Code. Section <br /> 23 18.49.170 is hereby added to the Colton Municipal Code to read as follows: <br /> 24 <br /> 25 "18.49.170—Applicability of Standards and Amortization of Nonconforming Uses. <br /> 26 All zoning, design and performance standards set forth in this chapter are deemed to be <br /> necessary for the protection of the public health, safety and welfare and shall be applicable <br /> 27 <br /> and govern all existing and proposed adult businesses in the City. <br /> 28 <br />
