1 RESOLUTION NO, 2449 2 • WHEREAS, the Planning Commission of the City of Colton did 3 through its Resolution No, 395 submit the following recommendation to the 4 City Council. 5 That the applicat ion of Anna E. Hyland for the rezoning of the parcel 6 of land situated at 1089 Rancho be denied for reasons set forth in its Resolution 7 Nos 395. 8 WHEREAS, on the 28th day of February, 1964, Mrs. Hyland did 9 submit to the City Council an appeal on the decision of the Planning Commission 10 and 11 WHEREAS, the City Council gave Notice of Public Hearing as re- 12 quired by law, and 13 WHEREAS, the City Council did hold said Public Hearing on the 16th 14 day of March, 1964 to consider the application for Change of Zone, and 15 WHEREAS, numerous protests both oral and written were submitted 16 by property owners in the area who expressed the desire to retain the present 17 zoning, 18 NOW,,, THEREFORE, BE IT RESOLVED by the City Council of the 19 City of Colton that the application for Zone Change at 1089 North Rancho Avenue 20 from R-1 to C-1 Zone be and it is hereby denied as it appears to the City Council 21 that the public interest, necessity, convenience and general welfare will best 22 be served by denying the request for rezoning as recommended by the Planning 23 Commission, 24 It is the opinion of Council Members that the Zone Change would 25 constitute spot zoning and as such is not desirable for the best interest of the 26 27 City; therefore the application is hereby denied without prejudice. 28 I HEREBY CERTIFY that the foregoing resolution was duly adoptedby the City Council at an adjourned regular meeting of the City Council held on the 29. 16th day of March 1964 by the following vote, to-wit: 30 AYES: Councilmen Rimbaugh, Kaney, Holtzendorff, Spragins, Oliva 31 NOES: Councilmen None 32 _ City Gle�rk
