1 RESOLUTION NO. 2479 <br /> 2 WHEREAS, the City of Colton, California operates a municipal <br /> 3 electric system for the purpose of providing abundant, low-cost electricity <br /> 4 to its citizens, and <br /> 5 WHEREAS, wholesale electricity which is distributed through Colton's <br /> 6 municipal electric system is purchased under contract from the Southern <br /> 7 California Edison Company, and <br /> 8 WHEREAS, an unwarranted increase in the rate paid by the City for <br /> 9 this wholesale electricity made it necessary for the City of Colton in 1958 to <br /> 10 seek the assistance of the Federal Power Commission, and <br /> 11 WHEREAS, the Commission, after public hearing, asserted Federal <br /> 12 jurisdiction and ordered a reduction in said rate, and <br /> 13 WHEREAS, the United States Supreme Court, in a unanimous opinion, <br /> 14 has upheld Federal jurisdiction in this case, and <br /> 15 WHEREAS:., Federal regulation of wholesale sales of electricity in <br /> 16 interstate commerce is in the public interest and protects consumers served <br /> 17 by the City of Colton and more than 900 other municipalities purchasing <br /> 18 electricity for resale from private utilities operating in interstate commerce, <br /> 19 and <br /> 20 WHEREAS, Rep, Harold D. Cooley (D., N.C. ) has introduced a bill, <br /> 21 H.R.11081, which, if enacted by the U. S. Congress, would virtually wipe out <br /> 22 such Federal regulation of wholesale sales to municipal electric utilities, <br /> 23 NOW, THEREFORE, BE IT RESOLVED: That the City Council of the <br /> 24 City of Colton, California, opposes any effort to invalidate the unanimous <br /> 25 opinion of the U.S.Supreme Court in the Colton Case, including H.R. 11081, <br /> 26 which is now under consideration by the Committee on Interstate and Foreign <br /> 27 Commerce of the U.
