R-19-24 <br /> 2 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> 3 COLTON, CALIFORNIA TO SET THE PUBLIC HEARING FOR THE <br /> ANNUAL WEED ABATEMENT PROGRAM FOR MARCH 19,2024 <br /> 4 <br /> WHEREAS, there are weeds growing upon the streets, sidewalks, and private property <br /> 5 within the City of Colton, and <br /> 6 <br /> WHEREAS, there is rubbish, refuse and dirt upon the parkways, sidewalks, and private <br /> 7 property within the City of Colton, and <br /> 8 WHEREAS, said weeds and said rubbish, refuse and dirt constitute a public nuisance, and <br /> 9 <br /> WHEREAS, due to the extensive personnel, time and expertise needed to direct the <br /> 10 abatement process, a fee must be charged for administrative procedures. <br /> 11 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br /> 12 HEREBY RESOLVE AS FOLLOWS: <br /> 13 SECTION 1: The staff report accompanying this resolution is found to be true, adopted <br /> 14 as findings and incorporated into this resolution. <br /> 15 SECTION 2: That all weeds growing upon the streets, sidewalks and private property <br /> within the City of Colton are declared to be a public nuisance and subject to abatement. <br /> 16 <br /> SECTION 3: That all rubbish, refuse and dirt, upon the parkways, sidewalks and private <br /> 17 property within the City of Colton are declared a public nuisance and subject to abatement. <br /> 18 <br /> SECTION 4: That the Fire Chief of the City of Colton is hereby directed to give notice <br /> 19 to the following described properties that there are on said premises, weeds or rubbish which <br /> 20 constitute a public nuisance, and which must be abated. <br /> 21 SECTION 5: That said notices shall comply with Section 39567.1 of the Government <br /> Code et. seq. <br /> 22 <br /> 23 SECTION 6: That said premises will be abated by the contractor selected by the City of <br /> Colton, as directed by the Fire Chief and in a manner approved by him. <br /> 24 <br /> SECTION 7: That an administrative fee, according to the most recent approved fee <br /> 25 schedule,per parcel shall be charged. <br /> 26 <br /> SECTION 8: That upon the conclusion of the Abatement Program, all contractor fees, <br /> 27 plus the administrative fee charged to those parcels requiring work and not collected through the <br /> 28 normal billing process will be placed on the San Bernardino County Tax Rolls for collection. <br />
