FIRST AMENDMENT <br />TO THE PROFFESSIONAL SERVICES AGREEMENT <br />FOR WATER AND SEWER ENGINEERING SERVICES <br />This First Amendment to the Professional Services Agreement for water and <br />sewer engineering services ("First Amendment") is entered into this 17th day of July, 2001 <br />between the City of Colton ("City"), a California municipal corporation, and Krieger & Stewart, <br />a corporation ("Consultant"). City and Consultant are sometimes herein referred to collectively <br />as the "Parties." <br />RECITALS <br />WHEREAS, City and Consultant entered into that certain professional services <br />agreement for water and sewer engineering services for the FY 00-01 Water and Sewer Line <br />Replacements, Phase I Project ("Project") dated November 7, 2000 ("Original Agreement"); and <br />WHEREAS, the term of the Original Agreement was from November 7, 2000 to <br />June 30, 2001; and <br />WHEREAS, due to unanticipated delays in the Project, City and Consultant desire <br />to amend the Original Agreement to extend the term in order to allow Consultant to perform the <br />water and sewer engineering services. <br />NOW, THEREFORE, the Parties agree as follows: <br />AMENDMENTS <br />1. Section 3.1.2 (Term) of the Original Agreement is hereby amended to read <br />as follows: <br />"3.1.2 Term. The term of this Agreement shall be from November 7, 2000 to <br />September 30, 2002, unless earlier terminated as provided herein. Consultant shall complete the <br />Services within the term of this Agreement, and shall meet any other established schedules and <br />deadlines." <br />2 Except as specifically amended by the terms of this First Amendment, all <br />provisions of the Original Agreement shall remain in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First <br />Amendment on the date first herein above written. <br />[Signatures on Next Page] <br />R VPUB\JR\603518 <br />
