R-16-24 <br /> 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br /> 3 APPROVING A MODIFICATION OF ZONING ENTITLMENTS (DAP-001-668) <br /> INCLUDING AN ARCHITECTURAL & SITE PLAN REVIEW FOR A 474,021 <br /> 4 SQUARE FOOT WAREHOUSE BUILDING INCLUDING ANCILLARY OFFICE <br /> SPACE, CONDITIONAL USE PERMIT TO ALLOW A BUILDING HEIGT OF <br /> 5 130 FEET, AND VARIANCE TO ALLOW 114 PASSENGER PARKING SPACES <br /> INSTEAD OF 314 PASSENGER PARKING SPACES FOR PARCEL 1 BUILDING <br /> 6 1, (LOCATED AT 1500 AGUA MANSA ROAD) (FILE INDEX NO: DAP24-0008) <br /> WHEREAS, an application (File Index No. DAP24-0008) was filed with the City of <br /> 8 Colton by City of Colton with the consent of Pamela Steele of MIG Inc, (hereinafter"Applicant") <br /> for Modifications of Zoning Entitlements (DAP-001-668) including an Architectural & Site <br /> 9 Plan Review for a warehouse building, Conditional Use Permit to allow a warehouse building <br /> of 95 feet in height,and Variance to allow 114 passenger parking spaces instead of 314 passenger <br /> 10 parking spaces, located in the M-2 (Heavy Industrial) Zones within the Agua Mama Historic <br /> 11 District; and <br /> 12 WHEREAS, on February 28, 2023, the Planning Commission of the City of Colton held <br /> a duly noticed public hearing at which time all persons wishing to testify in connection with the <br /> 13 application were heard and the application was fully examined and the public hearing was <br /> continued to March 14, 2023; and <br /> 14 <br /> WHEREAS, on March 7,2023,in the form of a letter,the applicant requested to continue <br /> 15 the Planning Commission meeting from March 14 2023 to March 28, 2023; and <br /> 16 WHEREAS, on March 14, 2023, the Planning Commission of the City of Colton <br /> 17 conducted the continued public hearing at which time all persons wishing to testify in connection <br /> with the application were heard,the application was fully examined and continued the meeting to <br /> 18 March 28, 2023 at the request of the applicant; and <br /> 19 WHEREAS, the public hearing was continued to April 11, 2023 and subsequently to <br /> 20 April 25, 2023; and <br /> 21 WHEREAS, on April 25, 2023 the Planning Commission of the City of Colton held the <br /> continued public hearing at which time all persons wishing to testify in connection with the <br /> 22 application were heard and the application was fully examined,afterwards the hearing was closed, <br /> 23 and the item was continued to the May 9,2023 meeting where it was approved; and <br /> 24 WHEREAS, on March 5, 2024, the City Council of the City of Colton City Council <br /> conducted a public hearing on the project application and all persons wishing to testify in <br /> 25 connection with the application were here, and the applications were comprehensively reviewed; <br /> and <br /> 26 <br /> WHEREAS, on August 20, 2013 (Resolution No. R-60-13), the City of Colton, as the <br /> 27 lead agency under the California Environmental Quality Act ("CEQA"), certified a General Plan <br /> Environmental Impact Report ("General Plan EIR") and approved the General Plan on August <br /> 28 20, 2013; and <br />
